Welcome to ServerLy. By accessing or using our web hosting services at serverly.in, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptable Use Policy (AUP)

ServerLy provides web hosting services for legal purposes only. You agree not to use our servers for any illegal or abusive activities. The following activities are strictly prohibited and will result in immediate account termination without a refund:

  • Hosting or distributing copyrighted material without permission.
  • Phishing, scam sites, or distributing malware or viruses.
  • Sending unsolicited bulk emails (spamming).
  • Hosting child pornography or any content that violates the laws of India.
  • Utilizing excessive server resources that negatively impact other users on our shared servers.

2. Account Setup and Security

You are responsible for maintaining the confidentiality of your account login credentials, including cPanel and WHMCS access. ServerLy is not liable for any unauthorized access or data loss resulting from weak passwords or compromised client accounts.

3. Data Backups

While ServerLy may perform routine server backups, these are provided as a courtesy. You are solely responsible for keeping independent backup copies of your website files, databases, and emails. We do not guarantee data recovery in the event of hardware failure or accidental deletion.

4. Payments and Renewals

All hosting plans are billed on a prepaid basis. It is your responsibility to ensure that payment is made before the renewal due date. Failure to pay on time will result in the suspension of services, and eventually, the deletion of your hosting account and data.

5. Limitation of Liability

In no event shall ServerLy be liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of data, loss of profits, or business interruption arising out of the use or inability to use our services.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Ranchi, Jharkhand.
